Samsung VS Apple und Microsoft VS Motorola

Was soll man machen, am Klagethema kommen wir halt nicht drum herum. Immerhin ist es nun aber auch mal ein klein wenig “lustig”:

Samsung VS Apple
Samsung bedient sich in der Klage von Apple in den USA nun besonderer Mittel. Man verweist auf eine Filmszene. Dabei handelt es sich um den absoluten SF-Klassiker “2001: A Space Odyssey” von Stanley Kubrick. Immerhin aus dem Jahr 1968.
In der Filmszene scheinen 2 Crewmitglieder während des Essens jeweils ein “iPad-ähnliches” Tablet zu nutzen. Die Begründung der Samsung-Anwälte:

Attached hereto as Exhibit D is a true and correct copy of a still image taken from Stanley Kubrick’s 1968 film “2001: A Space Odyssey.” In a clip from that film lasting about one minute, two astronauts are eating and at the same time using personal tablet computers. The clip can be downloaded online at http://www.youtube.com/watch?v=JQ8pQVDyaLo. As with the design claimed by the D’889 Patent, the tablet disclosed in the clip has an overall rectangular shape with a dominant display screen, narrow borders, a predominately flat front surface, a flat back surface (which is evident because the tablets are lying flat on the table’s surface), and a thin form factor.

Microsoft VS Motorola
Microsoft verlangt vom International Trade Commission in Washington einen Importstopp für Motorola-Geräte. Als Grund hierfür nennt man Patentverstöße. Laut Techcrunch nennt Microsoft in seiner Klage unter anderem Droid 2, Droid X, Cliq XT, Devour, Backflip und Charm. Soweit alles doch eher veraltete Geräte. Eine Motorola-Sprecherin hat angekündigt, dass man sich gegen die “patent attack business strategy” von Microsoft zur Wehr setzen werde. Eine Entscheidung scheint erst für den November auszustehen.
